Big win at the Minnesota Supreme Court.

Congratulations to our attorneys Matthew Schaap and Cassie Wolfgram in a major win before the Minnesota Supreme Court. The decision reversed to $0 an incorrect determination that their client was obligated to pay back $1.2M paid for work performed for patients as part of a nursing and home care business that supported patients in the south metro who received health care in their homes.

The decision clarifies how cases must be treated when an ALJ issues a decision. It clarifies that a Minnesota department commissioner is now obligated to either adopt, modify or reject the ALJ’s findings of fact, conclusions of law, and recommendations, without the option to remand the case for further fact-finding, or any other reason once the report is issued.
This case also strengthens all administrative law decisions in Minnesota.
